Terms of Service

Welcome to Submarius. By creating an account or using the service, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the service.

The service is operated by Submarius LLC, a Wyoming limited liability company.

1. The service

Submarius is a mobile and web application that aggregates ocean and weather data and provides mode-specific conditions scoring for spearfishing, diving, fishing, boating, and related activities.

2. Your account

You may use Submarius without an account. If you create an account, you must be at least 13 years old (16 in the EU). You are responsible for keeping your credentials secure and for all activity under your account. Notify us immediately at support@submarius.com if you suspect unauthorized access.

You agree to provide accurate information and to keep it current.

3. Acceptable use

You agree not to:

• Misrepresent your identity or circumstances.
• Harass, threaten, or dox other users.
• Upload content you do not have rights to, or content that is unlawful, defamatory, or invasive of privacy.
• Scrape, reverse engineer, or attempt to extract the underlying databases or aggregated data without permission.
• Interfere with the service’s operation or security.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

4. Your content

You retain ownership of content you submit (photos, water-clarity reports, preferences). You grant Submarius a worldwide, non-exclusive, royalty-free license to host and process that content as needed to operate the service — including using aggregated and anonymized data to improve predictions.

You can delete your content at any time. Content may persist in caches and backups for a limited period after deletion.

5. Safety — important

Submarius provides information as a supplement to, not a replacement for, your own judgment, training, and direct observation of conditions.

• Ocean conditions, tide predictions, water-clarity forecasts, and bite scores are derived from third-party sources and predictive models. They can be incomplete, delayed, or wrong.
• Regulatory information displayed in the app is provided as general awareness, not legal advice. You are responsible for knowing and following the laws in your jurisdiction — always verify with the relevant wildlife or fisheries agency before heading out.

By using Submarius you acknowledge that ocean recreation is inherently dangerous and assume responsibility for your own safety.

6. Subscriptions and payment

Pro subscriptions are billed monthly or annually via Stripe (web) or the applicable app store (iOS / Android). A one-time lifetime purchase is also offered. Subscriptions auto-renew until cancelled. You can cancel at any time in your account settings (web) or your device subscription settings (iOS / Android).

• Free trials convert to paid subscriptions at the end of the trial period unless cancelled.
• Refunds are handled according to the platform’s policy (Stripe, Apple, or Google). We may issue discretionary refunds in exceptional circumstances.
• Prices may change. We will notify you by email at least 30 days before any increase affects your account.

7. Third-party services

Submarius integrates with and displays data from third parties (Open-Meteo, NASA GIBS, Esri, NOAA, RainViewer, OpenStreetMap, and others). Their data is subject to their terms; we make no warranty as to accuracy or availability.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUBMARIUS LLC AND ITS OPERATORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH ARISING FROM USE OF OR RELIANCE ON THE SERVICE. OUR TOTAL LIABILITY FOR DIRECT DAMAGES IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR US$100, WHICHEVER IS GREATER.

Some jurisdictions do not allow these limitations; they apply to the extent permitted.

10. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, your right to use the service ends; clauses that by their nature survive (ownership, disclaimers, liability limits, dispute resolution) remain in effect.

11. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws principles. Disputes shall be resolved in the state or federal courts located in Wyoming, unless local consumer law grants you stronger rights.

12. Changes

We may update these Terms. Material changes will be announced by email and in-app at least 30 days before taking effect. Continued use after changes take effect means you accept them.
